ITAR Controls on GPS/GNSS Receivers Updated

Today, the State Department published a final rule revising Category XII of the U.S. Munitions List (USML) under the International Traffic in Arms Regulations (ITAR).

Among other things, the rule updates the export controls on military GPS/GNSS receivers and moves them out of USML Category XV (Spacecraft Systems and Related Articles). They are now controlled under Category XII(d).

The vast majority of civil and commercial GPS/GNSS equipment does not meet the Cat XII(d) criteria and is therefore not subject to ITAR. Instead, it falls under the jurisdiction of the Commerce Department’s Export Administration Regulations (EAR).

The final rule, effective December 31, 2016, reflects public feedback on the draft rules published in February 2016 and May 2015.

Update: The Commerce Department issued its companion rule in December 2018.
